The website www.ben-bd.com (hereinafter “the Website”) is operated by Ben Vanderick (hereinafter “the Artist”). The Website presents and offers for sale original artworks and limited-edition screen prints created by the Artist (collectively referred to as “the Artworks”). Access to and use of the Website imply full acceptance of these Terms and Conditions of Use and Sale (“the Terms”). The Artist reserves the right to amend the Terms at any time. The applicable version shall be that in force on the date of the acquisition or consultation.
These Terms govern both (i) the use of the Website by any visitor or user and (ii) any acquisition of an Artwork made directly through the Website or by private contact with the Artist. All Artworks offered are original creations or limited-edition screen prints, each accompanied by a certificate of authenticity issued by the Artist. Descriptions and visuals are provided with the utmost care to ensure accuracy; however, minor variations in color, texture, or appearance may occur depending on screen settings or display media. Artworks are available within the limits of existing editions. Should an Artwork become unavailable after purchase, the collector will be informed promptly and any payment already received will be refunded in full.
Any acquisition made via the Website or by direct correspondence constitutes a firm and final acceptance of these Terms. The Artist reserves the right to refuse or cancel any order in the event of a prior dispute, suspicion of fraud, or non-payment. Prices are indicated in euros (€) and include applicable Belgian VAT. Shipping, insurance, and packaging costs may apply depending on the destination. Payment is due immediately upon confirmation and may be made by bank transfer or any other method indicated on the Website. The transfer of ownership becomes effective only after full payment of the total amount due.
All Artworks remain the exclusive property of the Artist until full payment has been received. In the event of non-payment, the Artist reserves the right to cancel the sale and reclaim the Artwork without prejudice to any other remedy. Deliveries are made within Europe only. Delivery times are indicative and may vary depending on the destination, the carrier, and the availability of the Artwork. The risk of loss, theft, or damage passes to the collector upon handover of the parcel to the carrier.
In accordance with Article VI.53 of the Belgian Code of Economic Law, no right of withdrawal applies to artworks created as limited editions or personalized works. Consequently, all acquisitions are final and binding as soon as payment has been made.
All content featured on the Website—including texts, photographs, images, videos, logos, layout, and displayed artworks—is protected under copyright and intellectual property law and remains the exclusive property of the Artist. Any reproduction, representation, or use, in whole or in part, without prior written consent from the Artist, is strictly prohibited. The acquisition of an Artwork does not entail any transfer of intellectual property rights; the collector acquires only the physical possession of the purchased piece.
The Artist shall not be held liable for any damage arising from use of the Website, technical issues, or force majeure events. In any dispute regarding an Artwork, the Artist’s liability shall not exceed the amount paid for the acquisition in question.
Personal data collected through communications or transactions are processed in accordance with Belgian and European data protection laws. Details of this processing are set out in the Website’s Privacy Policy, available on a separate page.
These Terms are governed by Belgian law. Any dispute concerning their interpretation, performance, or validity shall fall under the exclusive jurisdiction of the French-speaking courts of Brussels, unless otherwise required by mandatory provisions.
